Non-appearance of complainant

Cap. 99, s. 39 · Revised Edition 2020

If, when the cause is called, the defendant appears voluntarily in obedience to the summons, or is brought before the court under a warrant, and the complainant, having had due notice of the time and place of hearing, which shall be proved to the satisfaction of the court, does not appear in person or by an attorney-at-law, the court shall dismiss the complaint, unless the court, having received a reasonable excuse for the non-appearance of the complainant, or for other sufficient reason, thinks fit to adjourn the hearing thereof to some future day, upon such terms as the court thinks just.
