Apprehension of accused person on bail but about to abscond

Cap. 96, s. 63 · Revised Edition 2020

Where an accused person has been bailed in the manner aforesaid, the magistrate by whom he has been bailed, or any other magistrate or justice of the peace, if he sees fit, on the application of the surety or of either of the sureties of the person, and on information being laid in writing, and upon oath by that surety, or by some person on the surety’s behalf, that there is reason to believe that the person so bailed is about to abscond for the purpose of evading justice, may issue his warrant for the apprehension of the person so bailed, and afterwards, on being satisfied that the ends of justice would otherwise be defeated, may commit him when so arrested to prison until his trial, or until he produces another sufficient surety or other sufficient sureties as the case may be, in like manner as before.
