Provisions to apply to cases between the Government and the subject

This Part shall apply to cases between the Government and the citizen, Provided that when the State, or any officer on behalf of the State or the Government in his official capacity, is an appellant, neither the Government nor the State nor that officer shall be liable to give security for prosecuting the appeal, but if the State or the Government or that officer fails to prosecute such appeal, or if the decision appealed from is confirmed, then the opposite party may recover his costs in the manner provided in such cases for the recovery of costs against the State or the Government.
