Private enforcement

(1) Any person with sufficient interest may bring an action before a court with applicable jurisdiction to compel any authority of Belize or public official (including the Investment Committee, the Independent Oversight Board or the Public Information Office, or their respective members), [or any other person], to fulfil an obligation under or in relation to this Act, or to enjoin any action in violation of this Act. (2) Any person who brings an action under subsection (1) of this section, shall first have made a complaint to the Independent Oversight Board unless the Court, following a preliminary hearing, is of the view that there is a case to answer and that there is a material likelihood of material irreparable damage being suffered or of a person absconding if there is delay.
