Procedure to be same as in ordinary cases

Throughout the proceedings in the case of the goods being claimed as aforesaid, the bailiff by whom the levy was made, or, in the case of lands being claimed, the Chief Collector shall be the defendant, and all steps may be taken and things done as in ordinary cases before the said court, but the defendant shall not be ordered to pay any costs unless the court is of opinion that he has been guilty of wilfull neglect or misconduct.
