Penalty for using a pit not properly constructed

(1) It shall not be lawful for any person to construct or keep for use in any populous building area as defined in section 15 of this Act any pit, or well, sunk in the soil to serve as a receptacle for faecal matter, or other offensive or noxious matter or liquid, unless such pit or well is so constructed as to prevent the escape of its contents on to the surrounding soil. (2) Any person who offends against this section is liable to a fine not exceeding fifty dollars, and to a further fine not exceeding two dollars for every day during which the offence is continued.
