Approval of schools and institutions

(1) A person or body of persons wishing to operate a preschool, primary school, secondary school, tertiary, TVET or other educational institution shall apply to the Chief Education Officer for a licence to operate such a school or institution, 40 provided that the Proprietor of such an institution or school already in existence at the date of commencement of this Act and who has already received the approval of the Ministry to operate such an institution or school shall, upon application, be granted a licence under this Act. (2) The procedure and criteria for obtaining a licence to operate such a school or institution shall be set out in Rules made under this Act. (3) The Chief Education Officer shall maintain a register to be known as the Register of Schools in which it shall record particulars in respect of schools and institutions as required by this Act or Rules made under this Act.
