Offences

(1) Where no penalty is specifically provided in the Act, a person who contravenes these Regulations is guilty of an offence and shall be liable on summary conviction to a fine not exceeding twenty thousand dollars or to imprisonment for a term not exceeding two years and in the case of a continuing offence, to a further fine not exceeding one hundred dollars for each day or part thereof during which the offence continues after a conviction is first obtained. (2) In imposing any fine, the magistrate may order that the fine imposed, or a portion of such fine, be paid into an environmental fund established by the Department.
