Statement not required

(1) Where pursuant to regulation 8 the Department decides that an environmental impact assessment is not required but that a limited level environmental study is required, then the developer may proceed with the drafting and subsequent approval by the Department, of the terms of reference for that undertaking or project. (2) Where pursuant to regulation 8 the Department decides that neither an environmental impact assessment nor a limited level environmental study is required, then the developer may proceed with the developmental project or undertaking, subsequent to the granting of environmental clearance by the Department, subject to any other Act or regulation or guidelines 14 Environmental Protection or conditions laid down by the Department, and the payment of an environmental monitoring fee.
