Prohibition on discharge of pollutants

(1) No person, installation, factory or plant shall, unless specifically permitted by the Department, emit or discharge any pollutant into the atmosphere in contravention of the permitted levels specified under section 6 or 7. (2) Every person, installation, factory or plant emitting air pollutants is required to maintain and submit to the Department, records of the type, composition and quantity of pollutants emitted. (3) The Department, where necessary, may instruct the person, installation, factory or plant to make changes with regard to structure, method of operation or manner of disposing of air pollutants. (4) Any person, installation, factory or plant that contravenes this section commits an offence and shall be liable on summary conviction to a fine not exceeding five thousand dollars or to imprisonment for a term not exceeding two years, or to both such fine and imprisonment.
