Restriction on functions of customs clerks

(1) customs clerk shall not sign customs declarations, but may transact other business at the Customs and Excise Department for and on behalf of a customs broker by whom the customs clerk is supervised or employed. (2) A person who fails to comply with subregulation (1) commits an offence and is liable on summary conviction to a fine of not less than $500 and not exceeding $5,000. (3) A customs broker shall be liable for the acts or omissions of a customs clerk who is under his supervision or employed by the customs broker, where the customs clerk acted within the scope of his employment.
