Employee’s right to choose representative

Nothing in this Act shall prevent, or shall be read and construed as preventing, an employee with an individual grievance or involved in disciplinary proceedings from appointing and being assisted by a representative of the employee’s own personal choice, including an attorney-at-law or officer of a trade union other than a trade union certified by the Tripartite Body and recognised by the employer or employers’ organisation as the bargaining agent for the bargaining unit of which the employee is a member.
