Grant or refusal of certification

Pursuant to section 24 (4) of this Act, the Tripartite Body shall within three months after receipt of an application for certification by a trade union under this Part, (a) certify the trade union as the bargaining agent for the bargaining unit referred to in the application; or Trade Unions and Employers; Organisations (Registration, Recognition and Status) 29 (b) refuse to certify the trade union as the bargaining agent for the bargaining unit referred to in the application if it is satisfied that the trade union has failed to secure the highest number of votes in a poll held under section 28 of this Act; (c) refuse to certify the trade union as the bargaining agent for the bargaining unit if it is not satisfied of the suitability of the bargaining unit as provided in section 25 of this Act.
