Void Transactions

(1) A transaction is void to the extent that it purports to convey, assign, charge, anticipate or give as securityVoid 38 (a) a right to receive money payable under a pension plan; or (b) assets being transferred from a pension fund. (2) Sub-section (1) does not apply to a transfer required by a court order or pursuant to a property settlement agreement relating to the transfer of assets on a divorce or to an order or settlement agreement for the maintenance of a spouse.
