Procedure on confiscation or destruction

(1) Wherever a quantity of a regulated or unauthorised drug is scheduled to be confiscated, or destroyed by an inspector, the holder of the product licensee or a representative of the holder of the product licence shall be present at such confiscation or (2) Any person who is not present as required under subregulation (1) commits an offence and is liable on summary conviction to a fine not exceeding five thousand dollars, and shall be responsible for all costs of the action taken by the authorised officer from the Ministry.
