Provisional protection

(1) Where a breeder’s right is granted the holder of the right shall be entitled to equitable compensation for anything done during the application period which if done after the grant of the right, would constitute an infringement of it. (2) In this section, “application period”, in relation to the grant of a breeder’s right, means the period, (a) beginning with the day on which details of the application for the grant of the right were published in a periodical pursuant to section 28 (4) of this Act; and (b) ending with the grant of the right.
