Invalidation

(1) The Registrar shall invalidate a breeder’s right at the request of any interested person where it is established that, (a) the variety is not new or distinct within the meaning of, and on applicable dates referred to in, sections 6 and 7 of this Act; or (b) the holder of the right is not the owner of the (2) Where the fee prescribed in accordance with section 26 (1) of this Act, is not paid within three months of the request being filed, the request shall be deemed never to have been filed.
