Application by person other than owner

(1) Where an application is filed for a breeder’s right by a person who is not entitled to protection, the person entitled may bring an action before the Court for the assignment to him of the application or if the application is already granted, of the (2) No action shall be commenced after five years of the publication of the grant of the breeder’s right, save that an action brought against a defendant who has acted in bad faith shall not be subject to any limitation period.
