Distributions to beneficiary

Except as otherwise expressly provided in a foundation charter or the by-laws, all distributions of income or principal to be paid to a beneficiary shall be– (a) paid by the foundation directly to– (i) the beneficiary; (ii) the personal representative of such beneficiary; or International Foundations [CAP. 24:02 51 (iii) the guardian of a minor beneficiary or the guardian or conservator of an incapacitated beneficiary; or (b) where authorised, and not under duress, applied for the benefit of the beneficiary.
