Constructive trustee - beneficiary relationship

Where a person, who is not specifically appointed as a member, receives property for the benefit of another party, the relationship between that person and the other party shall be analogous to the relationship of a trustee and beneficiary in which such person and the other parties shall have the respective rights and responsibilities of a trustee and beneficiary under the Trusts Act, unless specifically stated otherwise in a document signed by that person and the other party.
