Presumption as to driver

Where a vehicle used in the commission of a traffic offence is unattended at the time of the offence and the driver or person in charge of the vehicle cannot be ascertained by reasonable efforts, it shall be presumed that the registered owner of the vehicle was the driver or person in charge of the vehicle at the time of the offence.
