Application to vary regulation

(1) The Inspector may, on receiving a written application from the manager, the OHSC, or a local union requesting the suspension or variance of a provision of the Regulations, suspend or vary the provision if, in the opinion of the Inspector, the provision is not necessary to health, safety or environmental protection at an individual mine. 74 (2) The Inspector shall ensure that the parties affected by an application are advised of the application and the subsequent decision respecting a variance.
