Interest in mineral rights to be created by instrument in writing

(1) A legal or equitable interest in, or affecting, a mineral right, is not capable of being created, transferred, assigned, effected or dealt with, whether directly or indirectly, except by an instrument in writing. (2) The creation of a legal or equitable interest in, or affecting, a mineral right does not affect the liability of the registered holder of the mineral right for any breach of the conditions of the mineral right or of any of the provisions of this Act.
