Cap. 223, s. 48 · Revised Edition 2020

Whenever the Commission, after enquiry, finds that public convenience or necessity requires the use by one public utility provider of the conduits, subways, poles, wires or other equipment belonging to another public utility provider, and that such use will not prevent the owner or other users thereof from performing their duties or result in any substantial 30 detriment to the service, and if the public utility providers fail to agree upon such use or conditions or compensation therefor, the Commission may make such Order as it deems reasonable directing that the use or joint use of the conduits, subways, poles, wires or other equipment be permitted and prescribing the conditions to be observed and the compensation to be paid in respect of the use so permitted.
