Appointment of Inspector to investigate the affairs of a public utility provider

Notwithstanding anything contained in the Companies Act, Cap.250, where an order to investigate the affairs of a company is sought in respect of a public utility provider, the order to appoint a competent inspector shall be made and the terms of such appointment shall be decided by the Minister acting on his own application after consultation with the Commission, or following an order of the Court to appoint an inspector under section 110(1) of the Companies Act, Cap.250, the appointment of the inspector shall be made and the terms of such appointment shall be decided by the Minister, and every appointment and the terms of every such appointment so made by the Minister shall be as valid and effectual as if made by the Court itself.
