Applications and licences and manner of dealing with same

(1) The Minister may make Regulations under this Act which shall provide forsame. (a) conditions of eligibility for the making of applications under this Part; (b) the prescribed form and of applications, and relevant processing fees; (c) the manner of dealing with applications; and (d) the form, content, and the terms and conditions (2) In exercising his authority under sub-section (1), the Minister shall have regard to the following– (a) the owners or occupiers of land on which, adjacent to which, or under which water occurs, and any person who has secured amicably or by compulsory acquisition such an interest in the land as to give him access to the water shall be eligible to make an application under this Part; (b) an application under this Part may contain a request for the approval of proposals for the disposal of waste water if these have been classified for in accordance with Part VI or if the area where the proposed discharge occurs or which is affected by the proposed discharge has been classified in accordance with Part VI; and (c) in the process of screening an application, adequate opportunities shall be provided for the protection of all actually or potentially affected interests, and for public comment. 74 (2) The reasons for decisions taken on applications under this section shall be given in writing.
