Removal, etc., of line or posts, where necessary to use land

(1) Where any person desires to use land in a way that makes it necessary to remove to another part of the land any water pipe or waterworks maintained by a licensee in, over or upon the land under section 43 or alter such water line or waterworks in any way, he may by notice in writing served on the licensee require the removal or alteration of the water line or waterworks or, post, pole, pillar, or other works as the case may be. (2) Any expenses incurred by a licensee in complying with a requirement under sub-section (1), may be recovered from the person who made the requirement.
