Onus of Proof

(1) If in any proceedings under this Act, a person is charged with having committed an offence involving an act for which a license, authorization or other permission is required, the onus is on that person to prove that at any relevant time the requisite license, authorization or other permission was held by him. (2) If a person is charged with having unlawfully entered the jurisdiction area of another State, the onus is on that person to prove that his entry was for a purpose recognized by international law. (3) If a person is charged with having contravened this section, the onus is on that person to prove that the information given was true, complete and accurate.
