Payment out of capital

Where the value of a testator’s net estate does not exceed fifteen thou- sand dollars, the court shall have power to make an order providing for maintenance, in whole or in part, by way of a payment out of capital, so however that the court, in determining the amount of the provision, shall give effect to the principle of section 37 of this Act.
