Creation of a Trust

(1) A trust, other than a unit trust, may be created by oral declaration, or by an instrument in writing, including a will or codicil, by conduct, by operation of law, or in any other manner whatsoever. (2) A unit trust may be created only by an instrument in writing. (3) No formalities or technical expressions are required for the creation of a trust provided that the intention of the settlor to create a trust is clearly manifested. (4) A trust, other than a trust by operation of law, respecting land situated in Belize shall be unenforceable unless evidenced in writing.
