Appointment of new or additional Trustees

(1) Where the terms of a trust contain no provision for the appointment of a new or additional trustee, then21 (a) the protector, if any; (b) the trustees for the time being, but so that a trustee shall not be required to join in the appointment of his replacement; (c) the last remaining trustee; (d) the personal representative or liquidator of the last remaining trustee; or (e) if there is no such person, or no such person willing to act, the Court, may appoint a new or (2) Subject to the terms of the trust, a trustee appointed under this section shall have the same functions and may act as if he had been originally appointed a trustee. (3) On the appointment of a new or additional trustee, anything requisite for vesting the trust property in the trustees for the time being of the trust shall be done.
