Restriction on consolidation of mortgages

(1) No mortgages affecting any lands or tenements shall have any priority by reason of being held by or vested in the same person with another mortgage of prior date and (2) A mortgagor seeking to pay off any one mortgage is entitled to do so without paying any money due under any separate mortgage made by him, or by any person through whom he claims, solely on property other than that comprised in the mortgage which he seeks to pay off. (3) Nothing in this section shall operate to defeat the right of a mortgagee to recover at one time sums of money advanced at different times under the terms of any mortgage providing for advances made and to be made during the subsistence of the mortgage.
