General contract law to govern capacity to enter into tenancies

(1) Capacity to enter into any of the tenancies defined in this Act is regulated by the general law concerning capacity to contract and to acquire or to dispose of property. (2) All persons not under legal disability may grant leases for such terms as are consistent with their right, title or interest in the land or buildings, and all persons under no legal incapacity may hold leases.
