Service of Belizean process overseas

Cap. 103:04, s. 13 · Revised Edition 2020

(1) Process of the following descriptions, that is to say– (a) a summons requiring a person charged with an offence to appear before a court in Belize; or (b) a summons or order requiring a person to attend before a court in Belize for the purpose of giving evidence in criminal proceedings; may be issued or made notwithstanding that the person in question is outside Belize and may be served outside Belize in accordance with arrangements made by the central authority. (2) Service of any process outside Belize by virtue of this section does not impose any obligation under the law of Belize to comply with it, and accordingly failure to comply with any such process does not constitute contempt of any court nor is it a ground for issuing a warrant to secure the attendance of the person in question. 16 (3) Sub–section (2) is without prejudice to the service of any process, with the usual consequences for noncompliance, on the person in question if subsequently effected in Belize.
